A man was wounded when an ICE agent fired on him in New York City’s Marble Hill area on Thursday, October 8, and the Department of Homeland Security (DHS) says it happened during “a targeted enforcement operation,” according to the New York Post. A boy, 5, was sitting in the car with him and came away unhurt, according to police.
The gunfire came shortly after 4 p.m. near West 225th Street and Marble Hill Avenue, a local TV report says. The outlet adds that DHS alleges the man has gang ties and a record of earlier arrests, and that officers gave him aid right away. The Post describes him as a 28-year-old Dominican national who suffered a neck wound, and says he is expected to recover.
The New York Police Department told a local news site that none of its officers took part and that none were at the scene when the shots were fired. A photo caption on the site places FBI agents at the scene. Rep. Adriano Espaillat said the boy was back with his family, the site says, and added that agents would not let him see the wounded man at the hospital.
Protests and calls for transparency followed
Roughly 300 people gathered Thursday night outside Allen Hospital, where the man was being treated, the Post says. They chanted for ICE to leave city streets. Officers set up barricades, and the crowd pushed against them in one tense moment. The NYPD confirmed that at least five people were detained early Friday, according to the outlet.
The TV station also reported that demonstrators banged on police vehicles outside the hospital, and that protesters said the shooting had deepened fear and anxiety in immigrant communities. Gov. Kathy Hochul asked federal authorities for a full public account of what happened and for body camera footage to be released publicly, the local news site says.
The leader of a New York immigrant coalition called for an independent investigation led by the state attorney general’s office, according to the same site. The TV report adds that City Council Speaker Julie Menin said federal authorities “must provide us with a fully transparent account of what took place without delay.”
City officials told a New York TV station that ICE had been using a parking lot near the scene as a staging area. The local news site says the neighborhood has seen more ICE activity over recent weeks, and witnesses reported hearing several shots. One said she counted at least three. DHS says the man has “a prior criminal conviction for grand larceny” along with earlier arrests tied to assault, robbery, drugs and weapons.
The NYPD told the Post it has two earlier arrests on file for him in the city. The first, a 2023 robbery case, ended with a guilty plea to a grand larceny charge and a five-year probation sentence. The second, a 2025 arrest for selling drugs, has not been resolved.
