Is Modern Warfare 3 Going to Be Available on Game Pass?

The reason, according to Phil Spencer, the head of Xbox, is that the teams at Microsoft were not able to begin the technical work needed to get the games on the platform until the deal had closed, which happened on October 13. With the deal now done, they can work on getting the games onto Game Pass.
